General Online Store Terms

This website is the electronic store for the online sale of products (traded by RIST HELLAS) (henceforth, the “Store”) by the Private Company with the trade name RIST HELLAS I.K.E. and mark designation RIST HELLAS (TIN 800587299, 7th PFD of Thessaloniki, G.E.MI. no. 130937701000) that is headquartered in Greece, at no. 27, Georgikis Scholis Avenue, in Thessaloniki (henceforth, the “Company”). These General Terms of Service (henceforth, the GTS) are intended to state precisely, clearly and comprehensibly, in keeping with the principle of goodwill and the provisions that govern the validity of transactions, the terms that regulate relations between the Company and visitors and/or customers of the Store, pursuant to Greek Law 2251/1994 on consumer protection, and in particular the provisions regarding remote sales, and Greek Law 2472/1997 on the protection of individuals against personal data processing, as are currently valid.

Every entry to, browsing of, and transaction with our Store renders you a visitor and/or customer of the Store. Before you browse the Store, we ask that you ensure that you have read and fully understood these GTS and that you accept them, as any use and/or transaction henceforth between you and the Company through the Store shall entail your full and unconditional acceptance of these GTS.

 

Personal Data

The Company respects your personal data and ensures that the Store complies with the provisions of General Data Protection Regulation 2016/679 (GDPR), Greek Law 4624/2019 and of Greek Law 3471/2006 on the protection of personal data and privacy in electronic communications. In any event, the Company hereby confirms that any collection, processing and/or storing of your personal data shall only occur in accordance with the law and only with your explicit specific consent and solely for the purposes and to the extent that is necessary for the operation of the Store and the provision of specific services at your request, according to the following.

The Company hereby confirms that it shall not use your personal data for any purpose not specifically authorized by you, nor shall it transmit or disclose said data to third parties (natural or legal persons) not affiliated with the Company without your explicit and specific consent for that purpose, with the exception of those cases where disclosure is necessary to execute your order (e.g., associated courier companies) or is mandatory by law. 

Even though it is possible to browse our Store without the disclosure of your personal data, you can enjoy many more services if you consent to provide some personal data, depending on the service you are interested in. For example, in order to create a personal account on the RIST HELLAS website, you will be asked for your contact information (e.g. full name, postal address, phone no., email address); for correspondence with the Company (e.g. to file a complaint, to receive information/ promotional material) you will likewise be asked for your contact information, etc.

However, a necessary prerequisite to commence and conclude any transaction between us is the disclosure, on your part, of specific personal data, such as your full name and contact information, your payment information (e.g., your credit card number), the delivery address for your order, etc. Also, when you browse our Store while logged into your personal RIST HELLAS account, the Company may collect data from your computer’s operating system, your browser, and your IP address, in order to measure traffic, record your order history and shopping interests, for the purpose of improving its services or to keep an internal accounting file.

Underage persons may access our Store and its services only with the consent and under the supervision of their parents or legal guardians, and with no obligation to disclose their personal data. In the event that underage persons disclose their personal data, the Company deletes all relevant information without delay.

The Store allows its visitors/customers access to the file where their personal data that were collected as described above are stored, and permits them to rectify, erase, amend and supplement any data and information that they have submitted.

Security – Cookies – Links

To ensure safe browsing on our Store and to secure your transactions, the Company adopts every appropriate measure, implementing the latest, high-quality security specifications in keeping with market trends, such as, for example, the high levels of SSL (Secure Sockets Layer) encryption technology by Thawte that are applied during input of sensitive personal data and provide 256-bit encryption for communications. Please consider that we are doing everything in our power to protect your personal data, and that your safe browsing on our Store and the protection of the password to your personal RIST HELLAS account also depends on you.

Like the vast majority of websites, the Store has the capacity to use cookies in order to provide each visitor/customer with information and better services (order status, personal settings, etc.), as well as to ensure faster and more effective order processing. Cookies are small alphanumeric files that are downloaded and stored on visitors’/customers’ computers, and which store settings and preferences that you have already selected at the Store, so that these appear automatically in your subsequent visits to the Store and help the Company to understand how you use the Store. Please note that cookies do not harm visitors’/customers’ computers, nor the files stored therein. However, it is noted that at any time you can use your browser’s settings to delete already stored cookies, stop the installation of new cookies, or request to be asked each time before cookies are installed on your computer (for more information, you can visit your browser’s customer service section).

On our Store you may encounter links leading to other websites, which are managed or owned by third parties (natural or legal persons) not affiliated with the Company or the Store. It is hereby stated that the Company and the Store are not liable for the content of such linked websites and the use thereof by visitors/customers, as these are located outside of the Store and outside the Company’s control. The display of such links does not entail any statement by the Company as to the reliability, security and content thereof, nor of the services and products offered through such links and use of such links is entirely at the discretion of visitors/customers. Consequently, for any problems that may occur during browsing such linked websites or in relation to your transactions with them, please contact the managers of such websites, who bear sole responsibility for these websites, directly.

 

Products Sold

The products sold by the Store are products traded by the Company (henceforth, the “Products”). The characteristics and accompanying information (e.g., warranty, identity, any instructions, etc.) of the Products sold are available and you may see them by following the search instructions listed on the Store and clicking on the name of the corresponding product. The prices listed on the relevant catalogues next to each product are inclusive of VAT (24%). These prices refer to Products and stocks that are available in the Company’s warehouse; the Store reserves the right to change prices without prior notice.

 

Submitting/Cancelling an Order

Submitting an order for Products shall constitute a binding offer to purchase said Products at the total price listed when submitting the order, which shall include VAT, packaging and shipping costs, other applicable charges, and any potential discounts that you may be eligible for as a visitor/customer. Your order is finalized when it is confirmed by the Company with a confirmation email sent to the email address that you stated when submitting the order in question. If you do not receive a confirmation email for your order, please contact the Store – our Company’s Online Store Department at +30 2310 511413 or at [email protected], in order to request the successful finalization of your order.

The Store uses an automated mechanism to cancel an order (partially or entirely) that has been submitted but has not yet been delivered. In order to cancel an order (partially or entirely), you must email us at [email protected], or call +30 2310 511413. This option is available until we notify you that your order has been dispatched. After that, orders cannot be cancelled.

 

Payments

Payment for your order can be made securely using Mastercard, American Express, Diners, Visa & Maestro debit/credit cards issued by any bank, through a security protocol (Security Certificate & SSL Technology), and confirmation is processed through the VISA and MASTERCARD 3D Secure Network. Payment can also be made through a secure PayPal transaction or by cash on delivery.

The Store has adopted all necessary measures to secure debit/credit card transactions. However, in the event that demonstrably there has been fraudulent use of your card, the charges may be cancelled by petitioning the bank that issued your card, which is responsible for investigating your complaint or claim. For this reason as soon as you become aware of such an incident you must immediately notify the issuing bank, in order to cancel your debit/credit card and prevent its use by unauthorized persons.

All payments made by credit/debit card are processed through the “Alpha e-Commerce” electronic payments platform by Alpha Bank, which uses TLS 1.2 encryption with 128-bit encryption protocol (Secure Sockets Layer – SSL). Encryption is a method for encoding information until it reaches its intended recipient, who is then able to decrypt it using the appropriate key.

 

Shipping Methods – Delivery Times – Costs

The Products are of excellent quality, up to international standards of quality and design; they are carefully packaged and are immediately available at the Company’s premises. If you request it on your order form, the Products may be shipped to you at your own responsibility and cost by courier service, at the latest within 10 days from the date when your order is confirmed, to the address you have indicated when submitting your order. Shipments are made Monday through Friday, excluding holidays. The shipping cost is the same for all destinations in Greece and varies only depending on the weight of the Products in your order.

The time required for delivery of the Products is contingent on the availability of the Products ordered in the Store’s warehouses, as well as on force majeure reasons (e.g., inclement weather conditions, strike, etc.), in which case we shall notify you by email or by phone to ask you if you still desire, under the circumstances, the completion of your order.

 

Prices of Products Sold

The prices listed on the relevant catalogues next to each product are inclusive of VAT (24%). These prices refer to Products and stocks that are available in the Company’s warehouse; the Store reserves the right to change prices without prior notice.

 

Returns

You have the right to return the Products you bought, without penalty and without obligation to supply a reason why you want to return them, within a deadline of 14 calendar days from the date of delivery. A necessary prerequisite is for the Product being returned to be in the exact condition that you received it, i.e., with no damage or wear and tear, and to be accompanied by the receipt and the warranty/exchange card, with a note that the Product in question is being returned according to article 8 of the GTS. To avoid any inconvenience, it is recommended upon delivery of your order that you personally inspect the condition of the Products sold and the integrity of the packaging, in order to note any obvious defects or problems with your order, the packaging, or the Products. In case of a return, you will be charged the shipping costs for the return of the Products and the Store will refund you, within calendar 30 days from the date of delivery, the amount the corresponds to the total market value and shipping costs of the Products that were returned, by the same method that was selected when ordering. Products are returned to the Company address listed hereinabove.

 

Advertising

The Store offers visitors/customers the option to choose to receive information about the Company’s new Products and about other offers and services provided by the Company, through promotional-information messages delivered to the email or postal address or to the phone number you have requested. The Store shall never abuse the above service. You may suspend this service at any time by emailing your request to [email protected].

Intellectual and Industrial Property Rights

Apart from the explicitly mentioned exceptions (intellectual property rights of third parties, associates, and entities), the entire contents of the website, including images, graphics, photographs, designs, texts, the overall look, the provided services and Products and in general all of the Store’s files constitute the intellectual property, industrial designs, distinguishing features, marks, symbols, signs and trademarks and service marks of the Company, its affiliated companies and undertakings and its suppliers, and as such are protected under the relevant provisions of Greek and European Law and international conventions. Any other products or services that may appear in the Store and that bear the marks of the respective organizations, companies, associates, entities, unions or publications, constitute their respective intellectual and industrial property and consequently their liability.  

 

Responsibility of the Parties

By accepting these GTS and browsing the Store, you the visitor/customer formally declare that you are legally competent to conclude this contract and to use the Store under the terms and conditions cited herein. Furthermore, as a visitor/customer of the Store you agree and accept that you are financially responsible for any use of the Store as well as for any use of your RIST HELLAS account by third parties – including by persons that live with you and so you agree to supervise any use of the Store by minor persons using your RIST HELLAS account or your name. The Company, including its consultants and employees, is only responsible for fraud or gross negligence and only for actual loss, and its liability cannot exceed the value of the Products sold.

 

Applicable Law, Jurisdiction and Other Terms

The Company and the Store reserve the right to amend or revise these GTS in writing without warning, and they shall be valid from the date of posting on the Store. The Company’s omission to exercise any right shall not be construed as waiving said right.

Browsing, using and transacting with the Store is governed by Greek Law, European Union Law, and relevant international conventions. Any dispute that may arise from browsing, using or transacting with the Store shall be tried before the competent courts of Athens, Greece. 

Any provision of the above terms that is rendered unlawful shall cease automatically to apply and shall be removed from these terms, without in any way affecting the validity of the remaining terms.

 

Electronic Conflict Resolution

The Company, in compliance with Regulation (EU) 524/2013 of the European Parliament and the Council of 21 May 2013 on online disputes, Directive 2013/11/EU of the European Parliament and the Council on alternative dispute resolution for consumer disputes, and Ministerial Decision no. 70330oik. (GG i. B’ 1421/2015), hereby notifies you of the option for extra-judicial resolution of any dispute concerning your transactions with the Store through the online dispute resolution platform of the European Union.

Any provision of the above terms that is rendered unlawful shall cease automatically to apply and shall be removed from these terms, without in any way affecting the validity of the remaining terms.
